Informal: Kosin vs. LNC

Title of appeal petition (edited):

In re: Failure of the Libertarian National Committee to Follow Holding of the Judicial Committee Decision Dated Dec. 3, 2024

Background

On October 6, 2024, the Libertarian National Committee (LNC) held a special meeting to consider preferring Charges and Specifications against LNC Secretary Caryn Ann Harlos (“Harlos”). Additionally, the LNC considered other motions such as a temporary suspension of Harlos’ duties and rights and the appointment of a trial manager for a trial to be held on November 9, 2024. On or about October 30, 2024, George Phillies and the requisite number of signatories appealed the motions passed at this meeting, and on December 3, 2024, the In re: Judicial Committee Appeal to Void LNC Decisions of October 6, 2024 declaring the motions null and void.

From the petition: "On December 4, 2024, after this ruling and past the time frame for rulings specified in the Judicial Committee Rules of Appellate Procedure, Chair McArdle invoked attorneys in an email attaching a letter to the JC. I believe this to be an inappropriate attempt to skirt the clear ruling of the JC and insert attorneys into a matter which was not mentioned in any of the Charges and Specifications. In fact, the LNC strongly asserted that any “pending legal matter” was not a pretext for their actions in their Reply to the automatic appeal filed by Harlos which is set to be heard by the JC on December 14, 2024."

"REMEDY REQUESTED

  • A voiding of the decision voting down Mr. Redpath’s motion to restore Harlos due to the December 3, 2024, JC decision;
  • A rebuke of the LNC for violation of its Bylaws-required duty to follow the rulings of the JC; and *An immediate restoration of Ms. Harlos rights including access to all LNC resources and a declaration that these rights were hers uninterrupted from her election at the 2024 National Convention."
