Burton Day was removed from his position as State Treasurer after refusing to transfer funds to the head of the ballot access drive. He then refused to turnover control of the party's bank accounts and withdrew the funds. He was charged with embezzlement during the 1983 Norman mayoral election and left the state. In 1989 Day was extradited from California, where he was serving four years in prison, and put on trial in Norman but was acquitted.
